Terms of Use – Kensho AI

These Terms of Use (“Terms”) govern your access to and use of the Kensho AI mobile application (“Application”), provided by Mauro Nadvorny (“Service Provider”, “we”, “us”, or “our”).
By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.
1. What Kensho Is (and Is Not)
Kensho AI is an emotional reflection tool designed to help users gain insight into their emotional state through voice-based interaction.
Kensho AI is NOT:
- A medical device
- A mental health treatment
- A therapist, psychologist, psychiatrist, or counselor
- A diagnostic or predictive system
- A substitute for professional care or human support
Kensho does not provide medical, psychological, legal, or professional advice.
2. Emotional Awareness, Not Diagnosis
Kensho analyzes emotional patterns in speech to offer reflective, supportive responses.
It does not diagnose conditions, assess mental health disorders, or determine risk levels with clinical certainty.
All outputs are informational and reflective only.
3. User Responsibility
You acknowledge and agree that:
- You are solely responsible for how you interpret and act upon information provided by Kensho.
- Any decisions, actions, or outcomes based on your use of the Application are your own responsibility.
- Kensho does not control, direct, or influence your real-world decisions.
4. Crisis & Alert Mode Disclaimer
Kensho includes a Safety / Alert Mode designed to recognize potentially dangerous language patterns and encourage external support.
Important limitations:
- Alert Mode does not guarantee detection of all crisis situations.
- It does not replace emergency services or professional intervention.
- Kensho cannot monitor you continuously or intervene directly.
If you are experiencing thoughts of self-harm, harm to others, or a mental health crisis, you agree to seek immediate help from qualified professionals or emergency services.
5. Limitation of Liability
To the maximum extent permitted by law:
- Kensho AI and the Service Provider shall not be liable for any direct, indirect, incidental, consequential, emotional, psychological, financial, or other damages arising from the use or inability to use the Application.
- This includes, without limitation, damages related to emotional distress, personal decisions, misinterpretation of outputs, or reliance on the Application.
You use the Application at your own risk.
6. Acceptable Use
You agree not to:
- Use the Application for illegal, harmful, or abusive purposes
- Attempt to reverse engineer, copy, or misuse the technology
- Use Kensho as a replacement for professional care
- Use the Application to make medical, psychological, or life-critical decisions
7. Intellectual Property
All content, technology, design, trademarks, and intellectual property related to Kensho AI are owned by the Service Provider or licensed partners.
You may not copy, distribute, modify, or create derivative works without prior written consent.
8. Suspension or Termination
We reserve the right to suspend or terminate access to the Application at any time if:
- These Terms are violated
- Misuse or abuse is detected
- Required by law or platform policies
9. Privacy
Your use of the Application is also governed by our Privacy Policy, which explains how data is handled, processed, and protected.
10. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Application after changes are posted constitutes acceptance of the revised Terms.
11. Governing Law
